Introduction
These Terms & Conditions govern all bookings, tours, safaris, and travel arrangements made with ASHN Elite Wild Escapes LLP and ASHN Elite Wild Escapes Africa Ltd, operating under the brand name "Go Beyond Safari" (hereinafter referred to as "ASHN", "we", "our", or "us").
ASHN operates from Bangalore, India and Nairobi, Kenya.
By confirming a booking with ASHN, the client acknowledges that they have read, understood, and accepted these Terms & Conditions.
Booking Confirmation & Payments
A booking shall be considered confirmed only upon:
- Receipt of the required deposit or full payment; and
- Issuance of a written confirmation invoice by ASHN.
Deposit requirements may vary depending on the destination, accommodation, airline, permit, or season.
Unless otherwise specified:
- Full payment must be received no later than 45 days prior to arrival.
- Bookings made within 45 days of departure require immediate full payment.
ASHN reserves the right to cancel any booking where payments are not received within the stipulated timelines. Any cancellation due to non-payment may attract applicable cancellation charges.
All bookings remain subject to availability until confirmed in writing.
Pricing, Currency & Taxes
All prices are quoted in United States Dollars (USD) unless otherwise specified.
ASHN reserves the right to revise prices in the event of:
- Currency fluctuations
- Fuel surcharge increases
- Government taxes or levies
- Park fee revisions
- Supplier price increases
- Circumstances beyond our reasonable control
Currency & Payment Terms:
- Payments to our overseas account must be made in USD.
- Invoices raised in India shall be payable in INR equivalent based on the prevailing exchange rate on the date of invoicing.
- Indian invoices are subject to applicable taxes including GST and TCS as per prevailing regulations.
- Bank transfer charges of USD 30 per transaction, which will be added to the remittance amount.
Child Policy
Child rates are applicable only where specifically stated and are generally valid for children below 12 years sharing accommodation with adults.
Hotel and lodge policies vary by property, and additional bedding may not always be available.
ASHN reserves the right to apply adult rates where the accommodation provider requires them.
Single Occupancy
Safari rates are generally based on double occupancy.
Clients requesting single accommodation may incur a single supplement charge, depending on availability and property policy.
Gorilla Permits & Special Permits
Gorilla permits and certain wildlife permits are limited, strictly controlled by government authorities, and subject to immediate purchase upon confirmation.
All Gorilla permits and similar special permits are:
- Non-transferable
- Non-refundable
- Subject to government regulations
Indian Wildlife Safaris
Indian tiger safaris and related wildlife experiences require advance planning and permit approvals.
Clients are strongly advised not to book flights or train tickets until safari permits and accommodations are formally confirmed.
Cancellation Policy
All cancellations must be submitted in writing and shall become effective only upon receipt by ASHN.
Cancellation charges shall apply as follows:
Low Season
- Less than 60 days prior to arrival: 25%
- Less than 45 days prior to arrival: 50%
- Less than 15 days prior to arrival: 100%
Peak Season
- Less than 90 days prior to arrival: 25%
- Less than 45 days prior to arrival: 50%
- Less than 30 days prior to arrival: 100%
Refunds, where applicable, shall exclude:
- Bank charges
- Service fees
- Non-refundable deposits
- Airline penalties
- Permit fees
- Supplier cancellation charges
Certain safaris, including Gorilla Trekking and Indian Tiger Safaris, may attract additional cancellation penalties.
We will not issue refunds for unused services once travel has commenced.
Force Majeure
ASHN shall not be held liable for failure, delay, alteration, or cancellation of services arising from events beyond our reasonable control, including but not limited to:
- Natural disasters
- Floods, fires, or adverse weather
- Political unrest or civil disturbances
- Government restrictions
- Pandemics or health emergencies
- Airline disruptions
- Acts of terrorism
- Strikes or industrial actions
In such circumstances, ASHN reserves the right to modify itineraries, postpone departures, or retain payments as future travel credit, subject to supplier policies.
Flights & Airline Responsibility
ASHN acts solely as an intermediary for airline reservations.
Flight schedules, timings, and routing are subject to change by airlines without prior notice.
ASHN shall not be liable for:
- Flight delays
- Missed connections
- Overbooking
- Denied boarding
- Airline schedule changes
- Additional expenses arising from airline disruptions
Any compensation claims relating to air travel must be made directly with the airline concerned.
Travel Insurance
Comprehensive travel insurance is strongly recommended for all travelers.
Insurance coverage should include:
- Trip cancellation
- Medical expenses
- Emergency evacuation
- Personal accident
- Loss of baggage
- Travel interruption and delay
ASHN is not responsible for any loss, theft, injury, illness, accident, or damage incurred during travel.
Inclusions & Exclusions
Services included in the itinerary shall be limited strictly to those specifically mentioned in the confirmed proposal or invoice.
Items not expressly stated as included are deemed excluded.
Age Restrictions
Certain camps, lodges, activities, and wildlife experiences may have minimum age requirements imposed by local regulations or supplier policies.
These restrictions must be communicated at the time of quotation or booking confirmation.
Photography and Marketing
During the course of travel, ASHN or its representatives may capture photographs and video footage for promotional and marketing purposes.
By confirming a booking, the client grants ASHN Elite Wild Escapes LLP / Go Beyond Safari a worldwide, irrevocable, perpetual, non-exclusive, royalty-free licence to use, store, reproduce, publish, modify, adapt, and distribute any photographs or video content captured by ASHN that may include the client or their guests.
Such content may be used across websites, social media platforms, brochures, presentations, advertising materials, and other promotional media without compensation or prior notice.
Clients who do not wish to appear in promotional material must notify ASHN in writing before travel commences.
Complaints & Claims
In the unlikely event of any complaint during travel, the client must immediately notify:
- The local guide or representative; and/or
- The hotel, lodge, or camp management
This allows reasonable opportunity to resolve the issue during the course of travel.
Any formal complaint must be submitted in writing to ASHN within 14 days from completion of travel.
Failure to notify ASHN within this period may affect the investigation and resolution of the claim.
Limitation of Liability
ASHN acts solely as an agent and intermediary between clients and independent third-party suppliers including hotels, camps, airlines, transport providers, and activity operators.
While every reasonable care is taken in arranging travel services, ASHN shall not be liable for:
- Personal injury
- Illness
- Loss or damage to property
- Delays
- Accidents
- Additional expenses
- Acts or omissions of third-party suppliers
Travel to wilderness, remote, and wildlife destinations involves inherent risks. By confirming a booking, the client voluntarily assumes all such risks associated with travel, safaris, wildlife encounters, adventure activities, and transportation.
To the maximum extent permitted by applicable law, ASHN's liability is limited to the total amount the client paid for the relevant tour or safari.
Governing Law
These Terms & Conditions shall be governed and interpreted in accordance with the laws of India and Kenya, depending on the contracting entity and jurisdiction applicable to the booking.
Any disputes arising shall be subject to the exclusive jurisdiction of the competent courts in Bangalore, India.
